代孕所生子女亲子关系确认的法律问题研究

目前,不孕不育已成为许多夫妻实现为人父母愿望的最大障碍,由此,基于繁衍后代的需要,越来越多的人把目光投向了代孕,但代孕所带来的法律与道德问题层出不穷,代孕所生子女更是被置于极其尴尬的境地,许多权益无法得到保障。因此,代孕所生子女亲子关系确认的法律问题成为我们不得不关注的问题。本文主要阐述代孕所生子女亲子关系确认的原则与代孕合法化的必要性,通过与传统亲子关系确认原则做比较,呼吁人们更多地关注代孕及代孕子女。

At present, infertility has become the biggest obstacle for many couples to realize their being parents＇ wishes. Thus, based on the needs of reproduction, more and more people turn their attention to surrogacy. But legal and moral problems brought about by surrogaey emerge one after another. Surrogate children are placed in an extremely awkward situation, and many of their rights and interests can not be guaranteed. Therefore, legal issues of confirmation of parent - child relationship of surrogate children have become the issue we have to pay close attention to. This article mainly expounds the principle of the confirmation of parent - child relationship of surrogate child and the necessity of legalization of surrogacy. Via comparing it with the confirmation principle of traditional parentchild relationship, the author urges people to pay more attention to surrogacy and surrogate children.
