新媒体用户微作品版权保护研究

Research on Copyright Protection of New Media Users' Micro Works

文章通过梳理近年来新媒体平台版权保护实践案例,阐明我国微作品的版权保护环境,探讨版权判定方法和归属,提出微版权保护和授权交易的新构想和新模型。建议由新媒体平台组织并提供技术支持,由用户响应并参与微版权自治管理,以集体管理交易与侵权和解交易方式,解决版权问题,挖掘微作品的内容价值,实现用户同新媒体平台的双赢。

Through long-term concern and analysis of related literatures and reports in recent years, this paper de-fines the concepts of micro-copyright and micro-works from the perspective of new media users, sums up detailedtypes of micro-works, analyzes the rule of creative micro work and the copyright attribution, clarifies the domestic envi-ronment of copyright protection, and puts forward a new idea on micro-copyright protection and authorization transac-tion. The paper proposes to manage the micro-copyright through the user autonomy and the technical support of thenew media platform, to dig the value of micro-copyright by collective management of transactions and infringement rec-onciliation, in order to realize the win-win situation between new media platform and users.
