摘要
现有法律范围内规定,承包人只有充分把握工程价款优先受偿权催告期限、行使期限的概念标准下,才能更好地在复杂建筑市场保护好自身权益。建设工程价款优先受偿权期限是承包人行使建筑工程价款的必要条件,研究建设工程价款优先受偿权期限问题在受偿权研究领域中具有很大的延伸空间。本文以建设工程价款优先受偿权期限问题作为研究切入点,对建设工程价款优先受偿权进行界定,立足于建设工程价款受偿权期限立法现状上,进一步分析建设工程价款优先受偿权期限规定存在问题并提出了相应的完善路径,为完善建设工程价款优先受偿权期限体系提供些许参考与建议。
