司法考试背景下地方高校刑法学教学改革探析

On the Teaching Reform of Criminal Law in Local Universities under the Background of Judicial Examinations

国家统一司法考试既是我国法律工作的职业化及国家法制统一的必然要求,更是我国司法改革的一项重大举措。司法考试中刑法学的考查标准与地方高校本科刑法学的教学存在着冲突。司法考试对刑法学教学提出严峻挑战的同时,也为推动刑法学的教学改革提供了契机。本文主要就地方高校刑法学教学如何与司法考试形成良性互动进行探析。

The establishment of a unified national judicial examination system is an inevitable requirement for the professionalization of our legal work and the unification of our state legal system, and alsoa major measure of judicial reform in our country. However, there are conflicts between the examination standards of criminal law in judicial examinations and the undergraduate criminal law teaching in local universities. While posing severe challenges to the teaching of criminal law, the judicial examinations also provide an opportunity to promote the teaching reform of criminal law. This article mainly analyzes how the criminal law teaching in local universities makes benign interaction with the judicial examination system.
