我国制造业创新中心知识产权相关政策研究——以比较法研究为视角

Intellectual Property Policy Research on the China Manufacturing Innovation Center——from the perspective of comparative law

制造业创新中心知识产权相关政策面临创新模式的转变、创新能力提升与创新目的转移三方面的挑战。我国在继美国和欧盟之后,于2016年10月出台了《制造业创新中心知识产权指南》,但由于时间仓促,在创新中心知识产权管理、创新中心知识产权保护和创新中心知识产权转移三个方面还存在不尽如人意之处。结合美国国家先进制造办公室知识产权小组制定的《国家制造业创新中心网络知识产权指南》和欧盟针对"Horizon 2020"项目所制定的相关知识产权政策的经验,建议平衡协同创新各方利益,强化制造业创新中心知识产权政策的社会性;充分发挥政策的灵活性,完善制造业创新中心协同创新生态环境;依据产业发展需求,提升制造业创新中心层面的成果转化。

The Intellectual property policy of Manufacturing innovation center,will face the challenges from shifting in innovation patterns,transferring of innovation purpose and improvement in innovation ability.Our government introduce ＂Guidance on intellectual property right for manufacturing innovation centers＂in October2016.This paper utilizes the method of comparison research to analysis the＂Guidance on intellectual property right for the national network for manufacturing innovation＂and the EU＇s＂Horizon 2020＂,give some suggests,firstly balance the interests of relevant parties in collaborative innovation;secondly change the traditional department of intellectual property management into the form of Institute-Developed and non-Institute-Developed intellectual property management;thirdly specific to the Institute-Developed intellectual property set the principal of transformation.
