国土资源信息公开及其行政复议和行政诉讼问题探讨

Administrative Reconsideration and Administrative Litigation in the Field of Land and Resources by Information Disclosure System

大量国土资源行政复议和行政诉讼案件由政府信息公开引发。本文梳理2010年以来国土资源部的行政复议和行政诉讼案件发现国土资源法律法规普及还不够,信息公开依法行政规范性不够。本文提出以下建议:加强宣传解读国土资源管理、政府信息公开、国土资源行政复议和国土资源行政应诉相关政策法律法规;加大信息公开力度,充分利用国土资源督察成果,主动为公众提供更多国土资源工作信息;加强国土资源工作人员依法行政的教育,正确对待公众诉求,依法办理政府信息公开相关的申请。

A large number of administrative reconsideration cases and administrative litigation cases in the land and resources field are due to the disclosure of government information. This paper has reviewed since 2010 the Ministry of Land and Resources＇ administrative reconsideration and administrative litigation cases and found that the existing laws and regulations are not well disseminated, the information disclosure is not enough, the administrative normativeness is not sufficient according to the law. This paper has put forward the following suggestions： Strengthen publicity and interpretation of land and resources management, government information disclosure, land and resources administrative reconsideration and land and resources administration litigation responding to the relevant policies, laws and regulations; Increase disclosure of information, make full use of the results of land and resources supervision, and actively provide the public with more information on land and resources work; Strengthen education in the administration of land and resources personnel in accordance with law, correctly address public appeals and handle applications for government information disclosure in accordance with the law.
