加强“一带一路”建设法治保障的基本路径初探

A Study on the Basic Ways in Strengthening the Legal Guarantee System of the Belt and Road Construction

构建"人类命运共同体"是人类社会共同的期盼。而"一带一路"倡议是推动构建人类命运共同体的重要路径,是沿线国家和地区实现和平与发展的客观需要,也是沿线人民追求和而不同、各美其美的殷切期盼。当然,推进"一带一路"倡议的实施,是一个前途光明而又任重道远的长期过程,其实施过程离不开法治的保障。当前,应从坚持立法协调,推动"一带一路"倡议实施的立法创新;坚持执法安全合作,加强"一带一路"倡议实施的执法磋商;坚持司法适用标准,强化"一带一路"倡议实施的司法协助;坚持"硬法与软法"相济,健全"一带一路"倡议实施争议的多元化解决机制等方面持续发力,从而为"一带一路"倡议实施打造相互尊重、公平正义、合作共赢的法治环境,为新时代完善全球治理体系、推动构建"人类命运共同体"树立示范样本。

The construction of human destiny community is the common expectation of human society. The Belt and Road Initiative is an important path to promote the building of a community of human destiny, an objective need for peace and development by the countries and regions along the line and their eager expectation in understanding themselves and discover their own form of beauty. Of course, advancing the implementation of the Belt and Road Initiative is a long-term process and cannot be separated from the protection of the law. At present, it is necessary to adhere to legislative harmonization to promote legislative innovation, law enforcement and safety cooperationto strengthen law enforcement negotiations and the applicable standards of the judiciary to strengthen judicial assistance. We must use the ＂soft law＂ and ＂the hard law＂ properly to diversify the solution mechanism for the implementation of the Belt and Road Initiative thus create a fairness, justice, and beneficial law environment. Then establish a demonstration sample in improving the global governance system and promote the establishment of a community of human destiny.
