生态红线管理制度探析

On the Legal Regime for the Ecological Redline Management

生态红线管理应当坚持如下原则:生态保护与生态建设并重、部门协同和公众参与、促进生态红线技术发展和一线一策原则。生态红线实行差异性管控措施,一级生态红线区和二级生态红线区分别适用不同的管控目标和措施。生态红线管理强调部门间协作,由人民政府及各部门之间协调以实现生态红线综合管理。生态红线调整必须依据法定的程序才具有法律制度的公信力和执行力,应当从生态红线调整主体、调整事由和调整程序三个方面完善生态红线调整制度。

Ecological redline management shall adhere to the following principles： equal importance of ecological protection and ecological construction,governmental departments collaborative management and public participation,promotion of technology for ecological redline and specialized management measures for specific ecological redlines. Different management measures are applied to ecological redlines at the first level and the second level. Management of ecological redlines are implemented by governmental departments collaborative to realize the integrated ecosystem management. The adjustment of ecological red line must be based on the legal procedure in order to have the credibility and executive power of the legal system. The adjustment system of ecological red line shall be perfected from three aspects： the main body of the adjustment of ecological red line,the reason of adjustment and the adjustment procedure.
