Environmental Regulation in the Construction and Development of Free Trade Port

海南自由贸易港的建设和发展中应处理好贸易与环境的关系。对于贸易与环境的一般关系在理论上有不同的观点,但实践中环境保护要求下的全球性和区域性贸易组织或协定的"绿化"已是不争的事实。相关贸易组织和自由贸易协定中大都有涉及环境规制的相关规则,其表现形式和主要内容存在差异,但总体上体现了内容日益详尽,规则逐渐具有约束力,争端解决愈发倾向于强制机制的特点。海南自由贸易港的建设与发展中应对环境规制给予充分的重视,应完善自贸港环境保护相关立法,加强环境保护准入管理,构建涵盖与环境有关的贸易争端的自贸港争端解决机制等。

The relationship between trade and environment should be dealt with in the construction and develop- ment of Hainan Free Trade Port. Although different views exist in theory in terms of the general relationship be- tween trade and environment, the ＂greening＂ shared by the global and regional trade organizations or agreements is an indisputable fact in practice under the requirements of environmental protection. The relevant rules concerning environmental regulation can be found in the certain trade organizations and free trade agreements, differing in their forms and main contents while generally sharing the characteristics of increasingly detailed regula- tions, the intensified restraints and the more compulsive system of dispute resolution. In the construction and development of Hainan Free Trade Port, due attention should be paid to environmental regulation. It is suggested to improve the relevant legislations related to environmental protection of Free Trade Port, strengthen access man- agement for environmental protection, as well as construct the mechanism of Free Trade Port dispute resolution that covers the environment-related trade disputes.
