摘要
云南大理市是全国宅基地制度改革试点。本文基于其宅基地集中规划、批新让旧和有偿使用等经验的法理分析,解释了宅基地使用权取得、交易以及宅基地管制的基本规则。为保障农民集体的主体地位,应赋予农民集体组织在宅基地使用权分配、有偿使用和退出中的决策权和收益权,赋予农民集体组织与其职能相适应的规划自主权。为适应村庄人口和功能已经发生的变化,在保障农民居住权的前提下,更新宅基地用益物权的实现方式和途径。
Dali city in Yunnan province is one of the homestead system reform pilot areas. Based on a jurisprudential analysis of Dali's experience regarding concentrated homestead planning, new homestead acquisition for renounced old homestead and paid use, this article explains the basic rules on acquisition of rural homestead use right, transfer of rural homestead use right and homestead control. To ensure the subject position of farmers' collective, the decision - making right and the usufructuary right, the right to self- determination should be granted to the organization for allocation planning, paid use and withdraw of home- stead. To adapt to the changes in villages' population and function, the homestead usufructuary system should be renewed on the premise of villagers' guaranteed right to habitation.
