习近平总书记在中国共产党第十九次全国代表大会上的报告中强调了解决"三农"问题的极端重要性,提出了实施乡村振兴战略的重大课题。实施乡村振兴战略,彻底解决"三农"问题,根本出路在乡村治理体系与治理能力的现代化,而乡村治理体系与治理能力的现代化必须要有一个比较健全的法制建构,解决现有乡村治理中存在的体系性问题。改革开放30多年以来,伴随着国家向社会让渡权力的进程,中国乡村社会的生产生活因利益分化而日益碎片化,乡村社会的治理体系发生了旷古未有的重大变化,多元治理的格局基本稳定,治理体系的民主化趋势日益明显,治理过程的民主协商逻辑逐渐成型。然而中国乡村社会多元治理的民主协商逻辑还缺少法律层面的规范建构。从法制建构的角度来考虑问题,中国乡村治理体系与治理能力现代化的当务之急就是要以法律规范的供给,为统一协调高效民主的乡村治理体系提供法制基础,实现乡村治理体系现代化所要求的整体协调性,落实中国乡村现代治理的协商民主政治逻辑,为实现新时代的乡村振兴伟大战略提供重要的政治基础保障。
