Idea and Mechanism of Cross-Border Fugitive Repatriation and Recovery of Stolen Asset in the New Era

习近平总书记新时代中国特色社会主义理论的提出,推动了跨境追逃追赃工作的理念转变。首先,必须树立国家治理维新和全球治理变革的理念,把跨境追逃追赃作为国家治理与全球治理的重要组成部分。其次,基于人类命运共同体的理念,必须认识到跨境追逃追赃不仅是特定国家的行动,也是全球其他国家的责任。基于上述理念,在新时代跨境追逃追赃工作的推进中,必须建立引渡替代机制、承认与执行外国判决机制、资产分享机制。

With the putting forward of socialism with Chinese characteristics,the idea of cross-border fugitive repatriation and recovery of stolen asset should be renovated. First of all,the idea of renovation of state governance and reform of global governance should be set up,and cross-border fugitive repatriation and recovery of stolen asset should be considered as an important part of state governance and global governance. Secondly,cross-border fugitive repatriation and recovery of stolen asset should be regarded not only as actions of specific nations,but also as obligations of other nations in the world based on the concept of community of human destiny. On account of the idea mentioned above,during the progression of cross-border fugitive repatriation and recovery of stolen asset in the new era,the mechanism for alternative measures of extradition and for the recognition and enforcement of foreign judicial decisions as well as asset sharing mechanism should be established.
