美国反贿赂合作机制及对我国反腐败机制发展的启示

The Implications of the U.S. Anti-Bribery Cooperation Mechanism on the Development of Anti-Corruption Cooperation Mechanism in China

美国反贿赂合作机制在规制企业贿赂犯罪与改善企业内部治理,促进企业持续发展问题上的优异表现,不仅实现了对企业贿赂犯罪的有效震慑,而且也成功地避免了给企业造成严重损害。从推进全面反腐,提高海外反腐与追赃追逃的角度出发,我国可以考虑借鉴美国反贿赂合作机制的经验,推动国家与被调查单位和个体间合作,通过与被调查单位及个人的合作配合,破解贿赂犯罪调查取证执法困局,完善单位自首、立功、坦白及单位缓刑制度,促进反腐败法律机制的发展完善。

The U. S. anti-bribery cooperation mechanism has gained notable achievements in regulating corporate bribery crime,improving the internal governance,and promoting sustainable enterprise development. It has realized effective governance of bribery crime without causing serious damage to the enterprises. To advance comprehensive anti-corruption and improve the ability of corruption crime governance in China,the U.S. anti-bribery cooperation mechanism can be taken for reference. Through modifying the unit surrender,merits,confession and probation system,promoting cooperation between the government and the units and individuals concerned,we can resolve the difficulty in conducting investigation and collecting evidence,and maximize the chance of detecting and tackling bribery crime.
