乡村振兴战略中的法治乡村建设

Promoting the Rule of Law in Rural China under the Strategy of Rural Revitalization

法治作为治国理政的基本方式,在中国走向现代化的征程中备受重视。《中共中央国务院关于实施乡村振兴战略的意见》第一次清晰地呈现了"法治乡村"概念。它以乡村振兴战略为时代背景,以提供乡村"有效治理"为历史使命,提出了约束乡村公共权力、规范乡村事务运行、保障农民权利等措施。法治乡村建设能够保障乡村振兴战略实施、落实全面依法治国、解决新时代新矛盾,与农村基层党建、村民自治、乡村德治和平安乡村一起,构成了"五位一体"的完整有效的乡村治理体系。当前,法治乡村建设应遵循整体性、差异性和渐进性原则,遵循法治建设的新方针,并以乡村公共法律服务做保障。

The rule of law,as a fundamental way of state governance,has beenextraordinarily highlighted in the course of China's modernization."Opinions of the CPC Central Committee and the State Council on Implementing theStrategy of Rural Revitalization",namely the"Central Document No.1 of 2018"clearly exhibited the concept of"rural governance under the rule of law"forthe first time.Under the historical background of rural revitalization,the concept took"effective governance"as its historical mission,promoted the restraintof rural public power,standardized the running of rural issues,and safeguarded peasants' rights etc.Promoting the rule of law in rural China may facilitatethe implementation of the strategy of rural vitalization,put"rule of law"into effect,and work out emerging proxies in a new era.Together with"Partyconstruction in rural grass-roots","villagers' self-governance","rule of village by virtue"and"peaceful village","rural governance under the rule of law"constitutes a complete and effective"five-in-one"system of"rural governance".Currently,the construction of"rural governance under the rule of law"shall embrace the principle of completeness,variance and graduation,follow the new policies for the construction,and support the construction with ruralpublic legal services.
