我国金融领域监管监管者的法律路径构建探析

由于近年来迅速发展中暴露出的乱象,我国金融领域凸显出构建监管监管者制度的必要性。政府失灵与管制失灵、规制"俘获""造租""寻租"等金融监管失灵理论是监管监管者制度的理论根基。基于金融监管失灵理论的指导,结合国外经验,从法律路径角度分析,金融领域可以分别构建起包含金融监管者评估机制、激励机制、监督问责机制和公众参与机制在内的监管监管者外部机制和囊括内部制衡、监管机构独立地位和监管者财政、人事独立的监管监管者内部机制。

As a result of the disorder in the process of rapid development in recent years,building a regulating regulator system is necessary for the financial field in China.The theory of financial failure of regulation,such as government failure and control failure,regulation capture,＂Rent making＂and＂Rentseeking＂,is the theoretical foundation of regulating regulator system.The failure of financial regulation based on the guidance of the theory,combined with foreign experience.From the angle of the legal path,the financial sector can build external financial regulating regulators system including evaluation mechanism,incentive mechanism,supervision and accountability mechanism and public participation mechanism,as well as internal financial regulating regulators system including internal check-andbalance,independent status,personnel and finance regulatory agency.
