海上丝绸之路建设的不断推进给海事仲裁带来新的内容，然受限于当前我国海事仲裁的固有理念，海事仲裁还不能很好地适应这种变化。对新类型的海事仲裁协议效力的认定将会遇到新的问题，最终的审查结果与海事实践及当事人的真实意思表示相悖，不利于海事仲裁和海事行业的发展。作为海事仲裁的支持者和监督者，海事司法在海事仲裁司法审查案件中，应及时更新理念，调整思路，努力适应“海上丝绸之路”建设的需要，充分保障海事仲裁发挥应有的作用。

The constant progress of the construction of Maritime Silk Road brings new content to the maritime arbitration. Subject to the inherent review concept formed in the realities of the arbitration industry in our country, the maritime arbitration judicial review in our country can＇ t yet respond to this change well. Determining the new type of maritime arbitration agreement encounters various problems, and the final review result is contrary to the maritime practice as well as the real intentions of the parties, which is not good to the development of the maritime arbitration and the maritime industry. Being the supporter and supervisor of the maritime arbitration, the maritime jurisdiction shall, in the maritime arbitration judicial review cases, timely renew the ideas and adjust the thinking, trying to adapt to the needs of the construction of Maritime Silk Road and fully guarantee the due role that the maritime arbitration should play.
