摘要
本文通过分析公司内部职务发明奖励和报酬规则是否有效的司法案例,归纳出司法的判断标准。建议将发明人职业"选择空间"的大小作为考量因素。
Through the recapitulation of a precedent judgement regarding the availability of reward and remuneration provision, which has been stipulated in the process of the service inventiveness in enterprises, this article summarizes benchmarks in reference on which the legal effects of the pre-invention assignment agreement could be tested, and suggests judges taking the leeway for employee inventors' free selection of jobs into account while making judicial decisions.
