Theoretical and Practical Innovations of the Local Legislative Power System

近些年来,关于地方立法的讨论涉及一系列理论和实践课题,尤其是地方立法权普遍配置于设区的市之后,有关设区的市地方立法的正当性、设区的市地方立法权的合宪性、设区的市地方立法权配置的合理性,以及设区的市地方立法的制度化、规范化、程序化、技术化等问题,需要理论界和实务界寻求共识,共同面向地方立法权配置上的变化及其带来的诸多问题。基于地方立法权的权力属性和运行逻辑,基于国家治理体系和治理能力现代化的需要,基于宪法部门思维和宪法政治原理,基于宪法规范及其确立的根本政治制度,充分论证地方治理与地方立法的关系,深化对地方立法权的合理性布局、地方立法权配置的合宪性、党领导立法的规范化、人大主导立法的有效性等问题的认识,科学阐释地方立法原则,完善和发展地方立法制度,实事求是地面向地方立法上"扩权收容"带来的实际问题,这无疑有助于更好地、完整地发挥地方立法权的应有效能。

In recent years,a series of theoretical and practical arguments have been discussed about the local legislation. Especially since the local legislative power was allocated to a city divided into districts,some problems have emerged such as whether the legislation in the cities divided into districts is legitimate,institutionalized,standardized,programmed or technology-based,and whether the legislative power is constitutional or rational in allocation. Therefore,the common views are needed to pursue in circles of theory and practice to deal with the changes and problems brought about by the configured local legislative power. On the basis of the local legislative power attribute and its operational logic,according to the thinking way of departments of Constitution and principle of Constitutional politics,the Constitutional norms and the established fundamental political system,and to meet the demands of modernizing the national management system and management abilities,this article fully demonstrates the relationship between local governance and local legislation,makes understood the rational layout of the local legislative power,the constitutionality in configuration,the legislative standardization led by the Party,and the effectiveness of the National People＇s Congress-dominated legislation,scientifically interprets the principle of the local legislation and the improvement of the local legislative system,and practically explains the real problems caused by the expanded local legislation power,as undoubtedly can help the local legislation power function more effectively.
