善治视角下设区的市立法质量问题思考

On the Legislative Quality of the City Divided Into Districts under the Perspective of Good Governance

基于善治视角的分析,设区的市在提高立法质量问题上受到立法理念相对滞后、民主立法拓展不深、科学立法遭遇技术阻碍等因素的影响。本文认为,应在善治理论的指导下,树立先进的立法理念,完善开门立法机制,重视立法技术与能力,增强立法特色,以此真正提高设区的市立法质量。

The fourth plenary session of the 18 th CPC centr al committee and the 19 th congress raised good law and good governance,and emphasized that good law should be adopted to promote development and ensure good governance.Since March 15,2015 the new revised ＂legislative law＂ gives legislative power,since in practice and academic circles on how to improve the quality of legislation from the perspective of practice and theory in-depth research,but on how to improve the quality of legislation under the perspective of good governance has not yet received enough attention.Based on the analysis of the good governance perspective,in the aspect of improve the quality of legislation in facing such as legislation idea relatively lags behind,the development of democratic legislation is not deep,scientific legislation in technical obstacles such as the obstacle factors.Therefore,improve the quality of legislation should be under the guidance of the theory of good governance,to establish the advanced idea of legislation,perfecting the open legislation mechanism,attaches great importance to the legislation technology and ability,strengthen the legislation of sex and maneuverability.
