学生宿舍作为高校的重要组成部分,其管理部门与学生之间形成的法律关系,是有效平衡宿舍管理权利与学生权利的基础。文章对宿舍管理的主体、内容和客体进行探究,得出在宿舍管理过程中,高校与学生之间形成的是平等的民事法律关系,即服务与被服务的合同关系;宿舍管理作为一种管理行为,是受民法保护的民事法律行为。

Being an important part of colleges and universities, the legal relationship between the administrative department and students is the basis of balancing the rights of dormitory management and students ＇rights. This article explores the subject,content and object of dormitory management, and draws the conclusion that in the course of dormitory management, equal civil legal relationship are formed between the universities and the students, namely contractual relationship of service and served;as a kind of administrative act, dormitory management is a civil legal act protected by civil law.
