论价格法规中价格欺诈条款的完善 被引量:1

On the Perfection of Price Fraud in Price Regulations

摘要 经营者在价格促销过程中所进行的价格行为应当受到价格法律法规的规制和调整。随着市场竞争的日趋激烈,经营者价格促销频繁,价格欺诈现象也随之多发。特别是在电商竞争日益激烈的背景下,更有不法商家以价格促销为名混淆视听行价格欺诈之实,谋取非法利益。本文首先针对当前市场普遍存在的价格促销行为进行了界定和分类,梳理了价格法规中有关规制价格欺诈的条款,分析了价格促销中存在着价格欺诈行为的主要表现。进而,提出了在未来相关制度建设中,进一步规范不同类别的价格促销行为,禁止价格欺诈行为的发生、切实保护消费者合法权益的建议。 The price method is the general term for the legal norms that the country uses to adjust the price relationships that are generated in economic activities. The price behaviors that operators perform during the price promotion process should be regulated and adjusted by price laws and regulations.Operator price promotions are frequent, and price fraud is also frequently occurring at high rates. Especially in the increasingly fierce competition of e-commerce, more unscrupulous merchants confuse audiovisual price fraud with the name of price promotion and seek illegal profits. For the existing price laws and regulations in our country, price fraud clauses are inadequate, in the future, system construction need to strictly regulate different types of price promotions, prevent the occurrence of price fraud, protect the legitimate rights of consumers, and maintain social harmony and stable.
