作为社会生活的一部分,体育对社会发展起着巨大的促进作用。但是,体育法能够形成法律一个独立的分支,并逐步成为一个独立的法律学科,且在体育学领域也是体育人文社会学的一个重要分支,其最重要的依据就在于体育具有其他社会活动所无法比拟的特殊性。体育的特殊性体现在体育组织机构的特殊性、体育规则的特殊性与法律适用的有限豁免性。尽管体育运动具有特殊性,并允许其在这些特殊的方面予以适度豁免,即法律对于体育领域的某些规范或行为不予审查。但其仍然不能游离于法律之外,还是应当纳入法律的适用范围。
