网络举报作为一种新型举报方式,是公民参与反腐倡廉工作的重要方式。但在司法实践中,举报人受到打击报复的情况却屡屡发生。由于复杂的社会环境,不法分子所实施的打击报复行为往往隐秘而千变万化,根据其行为主体、手段、对象等各方面差异,对其刑法定性时有可能会涉及报复陷害罪、打击报复证人罪、打击报复会计、统计人员罪、故意伤害罪等罪名,故在对这些打击报复行为进行刑法定性时,不能一味地把所有的打击报复行为均界定为报复陷害罪,而应当具体问题具体分析。

Due to the complicated social environment, the retaliation behaviors from criminals are secret and fickle. In the criminal law qualitative behavior, the retaliation behaviors should not only be defined as the case of retaliation frame-ups but should be determined by the specific of the cases because the behaviors sometimes, involve various criminal crimes such as the crime of false accusation, revenge against the accountant and statistician, intentional injury, and other charges.
