近年来,我国农药企业产品出口到美国时,接连遭遇了制备工艺的专利侵权诉讼。本文通过对涉及侵权诉讼的甲磺草胺、嘧菌酯制备工艺专利的分析比较,对侵权诉讼证据举证和无效宣告程序进行剖析,探讨农药制备工艺专利申请文件的撰写,为我国农药企业的专利申请提供建议和借鉴。

In recent years, Chinese pesticide manufactures had suffered patent infringement litigation of pesticide preparation process one after another when they exported their products to the United States. The paper analyzed and compared the patents about preparation process of sulfentrazone and azoxystrobin involved in the infringement litigation,investigated the process of proofing and invalidating the patent infringement litigation, discussed how to write a patent application on the preparation process of pesticides, and provided suggestions to the Chinese pesticide enterprises in patent preparation.
