权力清单制度的规范化运行研究:含义、困境与对策

Research on the Standardized Operation of Power List System:Definition,Dilemma and Countermeasures

权力清单制度自正式提出和实施以来,在实践中有效制约和监督了行政权力的运行,产生了良好的制度功效。但若以制度的规范化运行为评价标准,则不难发现权力清单制度仍然在制定、执行、监督等环节上面临着一些困境。为了解决这些困境,实现权力清单制度的规范化运行,可以通过明确权力清单的制定主体与制定程序、形成上下一致的权力清单编制模式、完善相关的法律体系与配套制度、强化权力清单制度的严格执行、建立权力清单制度的动态管理机制等方式对其加以规范和完善。

Since the power list system was formally put forward and implemented,it has effectively restricted and supervised the operation of administrative power in practice,and has produced a good system effect. However,if we evaluate the power list system based on the perspective of standardized operation,we can easily find that this system still faces some difficulties in the aspects of formulation,implementation,and supervision. In order to effectively solve these difficulties and realize the standardized operation of power list system,we can take the following measures： standardizing the formulating subject and formulating procedure of power list,forming the same staffing patterns of power list consistently up and down,improving the relevant legal systems and supporting systems,strengthening the strict enforcement of the power list system,and establishing dynamic management mechanism of power list system.
