体系化、公共性视域下公共文化服务立法的保障共治

The Protection and Co-governance of Public Cultural Service Legislation from the Perspectives of Systematization and Publicity

相对完备的公共文化服务立法是构建公共文化服务有效保障机制的必要前提。可运用法释义学分析方法,从阐明相关立法现状、厘清所涉核心概念的角度来探究该类立法的规范内涵,进而于该视域下尝试界定其价值目标,以就其未来发展完善指明方向。一方面,伴随《中华人民共和国公共文化服务保障法》的颁布实施,我国公共文化服务立法已初步形成一类相对独立的体系化部门法;另一方面,公共文化及公共文化服务作为公共文化服务立法所涉的核心概念,皆强调政府主导作用下的公共性要义,以凸显非营利性、非排他性及基于服务对象的普遍性。基于这两方面所成就的体系化、公共性之规范视域,可将该类立法的载体目的定向为保障法,并将其作用对象目的确立为公共文化社会共治。

A relatively complete public cultural service legislation is the prerequisite for constructing an effective protection mechanism for public cultural service. This paper uses the rechtsdogmatik analytical method to clarify the normal connotation of this kind of legislation from two aspects:the current situation of the relevant legislation and the core concepts involved. From this angles, the paper then attempts to define the legislation's value target and to point out how it will developed and improved. With the promulgation and implementation of The Public Cultural Service Protection Law of the People's Republic of China, the legislation for public cultural service in China has initially formed a relatively independent systematic department law. On the other hand, the public culture and public cultural service are taken as the core concepts in the legislation. They both emphasize the essence of publicity with the government playing the leading role, highlighting the non-profit and non-exclusive nature, and the universal service recipients. From these standard perspectives of systematization and publicity, this type of legislation's carrier is oriented to the protection law; and its object of action is targeted at social co-governance of the public culture.
