摘要
押金是共享单车企业营运的重要组成部分,对共享单车企业具有重要的作用。但在2017年,有六家共享单车公司破产造成押金难退的的问题受到外界广泛关注,这损害了用户的财产权益。我国立法对押金监管的规定还存在很大缺陷。因此,我们必须要从目前的立法着手,理性审视法律监管存在的问题并且提出合理的应对措施,以期切实保障用户的财产权益以促进共享单车市场良好地发展。
The deposit is an important part of sharing bicycle business and plays an important role in sharing bicycle business.However,in 2017,the problem that six shared bicycle companies went bankrupt and the deposit was difficult to return was widely concerned by the society,which damaged the property rights and interests of the users.There are still many defects in our legislation on the regulation of deposit.Therefore,we must proceed from the current legislation to rationally examine the problems of legal supervision and put forward reasonable countermeasures in order to effectively protect the rights and interests of the users and promote the good development of the shared bicycle market.
