On the Main Operation Modes of the Execution Convergence in the Field of Food and Drug

目的:为解决现阶段食品药品领域行刑衔接案件办理的低效与混乱,进一步探索能够在全国广泛推广的操作模式。方法:通过查阅相关文献资料,并结合现有模式,进一步系统梳理地方代表性操作模式,从中提炼能在全国推广的衔接程序。结果:坚持"食药+公安"的紧密协作机制,推进"两法衔接"信息平台系统建设,针对重大、复杂、疑难的案件专门成立专家委员会论证的综合办案模式可以保障案件的有效办理。结论:可以尝试探索在全国范围内推广这种综合模式,从而形成打击食品药品领域犯罪的长效机制。

Objective： To solve the problems of inefficiencies and chaos in the current executions in the field of food and drug and to further explore the operation modes that can be widely promoted throughout the country. Methods： Relevant literatures were reviewed, and the local representative operation modes were systematically analyzed combined with the existing modes so as to extract the convergence procedure that can be promoted nationwide. Results： The ＂food and drug ＋ public security＂ cooperation mechanism was adhered to, the construction of the ＂convergence of the two laws＂ information platform system was enhanced, and a comprehensive case handling mode was suggested by expert committee for major, complex and difficult cases in order to guarantee efficiency of executions. Conclusion： Promotion of the comprehensive mode nationwide should be explored so as to establish a long-term mechanism to suppress crimes in the field of food and drug.
