"三权分置"改革主导下的农村土地流转全面展开,作为土地制度改革的既定政策,在深化认知后,应对政策执行影响因素和效果做出理性分析,研究土地流转产生权利体系重构的实施路径。集体土地的制度创新必然导致权利主体增加,土地权利体系重构过程中的互动关系必然复杂化,利益与风险并存。清晰界定"三权分置"改革各方主体的权利和权能,激发制度优势和活力,同时识别和防范土地流转过程中的风险,避免农民主体性缺失、各方逐利产生违约风险。政府应强化土地流转契约的约束力和执行力,加强经营权流转的监督管理,建立土地流转履约保障机制,维护好经营权和承包权的主体利益。

The transfer of rural land under the guidance of ＂three-right separation＂reform is in full swing as an established policy of land system reform. After deepening the cognition,a rational analysis of the influence factors and effects of policy implementation should be carried out,and the implementation path of the reconstruction of the right system of land transfer should be studied. The institutional innovation of collective land will inevitably lead to the increase of right owners,and the interaction relationship in the reconstruction of land right system is bound to be complicated with coexistent interests and risks.In order to avoid the lack of farmers＇ subjectivity and the risk of breach of contract by all parties,the rights and powers of the parties of＂three-right separation＂should be clearly defined,the institutional advantages and vitality should be stimulated,and at the same time,the risks in the process of land transfer should be identified and prevented. The government should strengthen the binding and execution of land transfer contract,strengthen the supervision on operation right transfer,establish security mechanism for the performance of land transfer,and maintain the interests of operation rights and contracting rights.
