网络社会背景下《反不正当竞争法》的新变革与刑法应对

On New Change of Anti-unfair Competition Law and Countermeasures of Criminal Law under the Background of Network Society

新类型违法犯罪手段的涌现、违法犯罪空间的扩展、主体类型的丰富以及数据形态的崛起,均是信息网络时代对法律规制走向的冲击和影响因素。《反不正当竞争法》对信息网络时代的回应体现在第6条"禁止混淆的行为"和第12条新增的"互联网不正当竞争"条款。《反不正当竞争法》第12条规定的行为手段与刑法关于涉互联网犯罪的规定存在一定的关联与交叉,对于情节严重的行为,应适用刑法进行规制。

The emergence of new types of illegal and criminal means, expansion of illegal crime space, diversified subject types as well as the rise of data patterns are factors influencing laws and regulations in the age of information network. Article 6＂ prohibited confusion＂ and Article 12＂ Internet unfair competition＂ can find full expression in Anti -unfair Competition Law. There are certain correlations and crossovers in terms of behavior means in Article 12 in Anti - unfair Competition Law and stipulations of internet - related crimes in criminal law. If circumstances are serious, criminal law shall be applied to this behavior.
