当前人工智能侦查的应用困境及突破进路

Application Difficulties and Breakthrough Approaches of the Current Artificial Intelligence Investigation

在强大的科技引擎助推下,继"信息化"与"数据化"之后,"人工智能"走进侦查已经成为必然,人工智能侦查应运而生。当前,人工智能侦查较之于传统侦查在凸显出明显优势的同时,也面临着整合效果欠佳、指引功能发挥不足、前置性基础工作重视不够、法律规制失位与侦查权隐性膨胀、"权利"与"权力"之间冲突加剧等实践与理论困境。为了突破当前的应用困境,必须从强化实体性侦查资源整合、夯实基础性工作,加强人工智能侦查设备的整合、研发与集成应用,建立健全人工智能侦查应用的法律与规制体系入手,保障人工智能侦查效能能够强势发挥的同时预防侦查权在技术诱因的驱使下过度扩展和越轨行使。

With the help of powerful technology, artificial intelligence has been inevitably used in investigation after the IT application and digitization, and thus artificial intelligence investigation has come into being. Currently, compared with obvious advantages of traditional investigation, artificial intelligence investigation is confronted with practical and theoretical dilemmas such as poor integration, insufficient guidance function, lack of attention on basic work, absence of laws and regulations, invisible inflation of investigation power and intensifying conflict between ＂right＂ and ＂ power＂. In order to break through the application dilemma, we shall strengthen substantive investigation of resource integration, lay a solid foundation for basic work, strengthen the integration, research, development and application of artificial intelligence ce equipment, establish and improve the application of law and regulation system of artificial intelligence investigation to ensure that efficiency of artificial intelligence investigation can be developed and prevent investigation power from excessively expanding and deviating driven by technology incentives.
