欧盟碳市场法制建设若干特点及对中国的启示 被引量:5

Some Characteristics of EU’s Legal System in the Carbon Market and Its Revelation to China

摘要 作为最早的碳市场践行者,欧盟经验对中国碳市场及其法制建设起着重要的示范作用。分析欧盟碳市场政策法律的演进过程,可以看出其在推动和保障碳市场健康发展方面呈现出三个主要特点:碳市场政策法律制定和调整的及时性;与其他减排工具法制建设的统筹性;与国际碳交易规则融合与衔接的开放性。借鉴欧盟经验,中国碳市场的法制建设工作应处理好以下四个主要问题:尽快出台统一的碳市场基本法;重视碳市场与其他减排工具法制建设工作的统筹协调;注重不同类型碳市场之间衔接规则的制定;突出碳交易市场价格风险防控法律制度构建的重要性。 On the basis of analyzing the evolution of EU's carbon market policies and laws,this paper summarizes three main characteristics of promoting and protecting the healthy development of the carbon market. First,the timeliness of the law making and adjustment of the carbon market policy; second,the integration of legal system construction with other emission reduction tools; third,openness and convergence of international carbon trading rules. According to EU experience,China should deal with four problems. First,unifying the basic law of the carbon market as soon as possible; second,attaching importance to the co-ordination of carbon market and other emission reduction tools in legal system construction; third,laying stress on the formulation of rules of convergence among different types of carbon markets; fourth,highlighting the importance of building a legal system for price risk prevention and control in carbon trading market.
