法庭科学视域下电子签名的应用问题分析

Analyses on the Problems of Employing E-signatures from the Prospective of Forensic Science

自2004年电子签名法颁布以来,我国电子签名因其效力得到法律的确认,在越来越多的领域取代传统签名的确认方式。然而在电子签名技术应用过程中,仍然存在安全问题、责任认定过程中证据的可采性以及证明力判断标准不明确的问题。因此,以法庭科学为视角分析、梳理当前电子签名应用中的法律问题和技术问题,可为电子签名的使用者提供技术参考,为法官审查判断证据提供思路,为电子签名技术提供者、监管部门提供改进的方向。

Since Electronic Signature Law was promulgated in 2004, the validity of e-signature has been confirmed by law and this type of signature is gradually becoming the alternative of traditional hand-written signature in many situations. However, during the process of employing electronic signature technology, there exist problems concerning security in using e-signatures, bewilderment of whether they can be accepted as evidence and the discrimination criteria of their probative force. Thus, analyzing legal and technical problems of employing e-signatures from the prospective of forensic science can help the users to choose better electronic technique, the judges to examine and ascertain the evidence, and can also provide improving directions for the providers of e-signature techniques and supervision departments of employing e-signatures.
