网络环境下著作权保护制度的完善路径——以湖北省新闻作品的保护为重心

随着网络技术的进步,著作权的保护环境变得更复杂,网络服务提供者成为了新型著作权法律关系中的重要角色。网络环境下著作权侵权成本低、侵权方式和途径多样化,但维权成本偏高且技术难度很大,从而导致著作权维权复杂化,也给著作权保护机制带来了巨大的冲击。从湖北省新闻作品保护的角度分析,存在新闻作品传播和著作权保护的矛盾升级、新旧媒体融合困难等现象,阻碍到了湖北经济的发展。"今日头条"的著作权纠纷给湖北省新闻出版业带来诸多启示:亟需具体化网络文字作品的著作权保护制度、完善新闻作品的合理使用制度,坚持"内容为王",促进新旧媒体融合发展并建立著作权联合保护机制。

With the progress of network technology, the environment of copyright protection is getting more complex, and the network service providers have become an important part in the new legal relationship of copyright. Under the network environment, owing to such factors like low cost of copyright infringement, diverse ways of infringement, costly legal rights protection and many emerging technical difficulties in the actual practice, the protection for copyright becomes more complicated and exerts a great impact on the copyright protection mechanism. A study on the news works protection in Hubei province has revealed the following phenomena hindering the economic development of Hubei province： the escalated contradictions between the dissemination of news works and the copyright protection, and the difficulties in the integration of the new and the old media. Jinri Toutiao（meaning Today＇s Headlines） got involved in many controversies about copyright infringement and brought a lot of inspirations to the press in Hubei Province： the copyright protection system for the works on the Internet should be more concrete; the system of rationally using the news works needs to be improved; it＇s imperative to adhere to ＂content is the king＂, promote the integration and development of the new and old media and establish a united mechanism of copyright protection.
