我国公共图书馆孤儿作品利用的版权法适用

On the Application of Copyright Law to Orphan Works in Public Library of China

孤儿作品是作者身份不明或作者身份确定但查找无果的作品。公共图书馆等公共文化机构是保存孤儿作品数量最多的机构,负有保存、提供、传播孤儿作品的社会功能与价值。制度的缺失与不足导致我国公共图书馆不能对孤儿作品进行有效利用,造成作品数字化项目中的资源黑洞。鉴于公共图书馆的公益性,我国公共图书馆孤儿作品使用的法律制度应适度扩大作品合理使用范围、对图书馆孤儿作品授权使用进行专门或专款立法、科学选择孤儿作品的使用模式、合理确定"尽力查找"与付费标准。

The works,whose author＇s identy is not clear or the author＇s identy is clear but the auther can not be found,are called orphan works. As a public culture institution, public library is the location where most of the orphan works are reserved, and it acts as a platform to reserve, offer and spread the orphan works. As a result of policy deficiency, the orphan works in the public library can not be effectively used, which leads to a black hole in digitalized recources. For the public benefit of the library,certain law related to the use of orphan works should be extended to cover more. Specific law involving the authorized use of orphan works should be made. Scientific choice of the use mode related to orphan works is supposed to be made. Suitable standard should be set to define the search efforts and payment.
