地方政府参与海外劳工领事保护问题研究

Study on the Participation of Local Governments in Consular Protection of Overseas Labors

领事保护是维护海外劳工权益的重要方式。实践中地方政府参与海外劳工权益领事保护取得了一定成就,但领事保护实施机制不完善、领事人员不足以及海外劳工的教育培训缺乏等问题仍困扰着地方领事保护工作的实施。必须构建全面多元主体参与的保护协调机制,充分发挥政府、企业和工会的力量;加快服务平台建设,规范劳务外派行为;细化教育培训体系,增强劳工能力。

Consular protection is an important way to safeguard the rights of overseas labors.In practice,local governments have made some achievements in consular protection,but some problems still need to be solved,i.e.the imperfect consular protection enforcement mechanism,inadequate consular staff,and lack of training for overseas labors.Therefore,it is necessary to build a comprehensive and multi-agent participation protection coordination mechanism,give full play to the power of the government,enterprises and trade unions,speed up the construction of service platforms,standardize labor assignments,refine the education and training system,and enhance labor capability.
