我国数字音乐著作权许可模式的动因、路径与展望

Motivation, Path and Prospect of Copyright Licensing Model of Digital Music in China

我国音乐著作权许可模式的路径选择,存在着"左右为难"的现实挑战:一方面,立足于直接许可制度的独家授权模式,因行政性指导意见的否定,而无法继续开展;另一方面,寄托于集中许可制度的广泛授权模式,也因存在着一定的制度障碍和不足,而无法获得相应的认同。由此可见,重塑我国数字音乐著作权许可模式的应然走向,既需要充分尊重音乐产业自身的商业模式,也需要有效转变"家长式管理"的行政指导理念,以及运用好相应的法律规制手段,以实现我国音乐产业的良好发展。

Under the multiple influence of technological development, business model changes and policy guidance, the path selection of our music copyright licensing model is facing the ＂dilemma＂ of realistic challenge： on the one hand, the exclusive licensing model based on the direct licensing system cannot be smoothly carried out due to the negative effects of the administrative guidance; on the other hand, the extensive licensing model based on the collective licensing system resulted from the existence of certain institutional obstacles and insufficient cannot win wide recognition. Therefore, it is necessary to reshape the copyright licensing model of digital music in our country not only to fully respect the music industry＇s own business model, but also to effectively change the concept of ＂paternalistic management＂. Also, to appropriately apply the corresponding legal regulation will help to achieve the sound development of our music industry.
