现代化、改革开放与经济法的生成

中国40年的改革开放,对现代经济法制度的生成具有直接影响,对此有必要着重从现代化的维度,在"现代化——改革开放——经济法"的分析框架下展开研究。正是基于对现代化目标的追求,国家才不断进行改革开放,推进"制度的现代化",并使现代经济法得以生成,因此,实现现代化既是推进改革开放与经济法生成的共同前提和连接点,也是改革开放与经济法生成的目标和媒介。从现代化的维度反思改革开放过程中经济法制度生成的逻辑,有助于理解构建现代经济法制度的必要性,以及经济法推进国家治理现代化的功能和特殊重要性,也有助于丰富经济法的发生论,推进相关的"发展理论"的研究。

The 40 years of reform and opening-up in China have a direct impact on the formation of a modern economic law sys- tem. It is necessary to focus on the dimensions of modernization to carry out research under ananalytical framework of ＂moderniza- tion-reform and opening-up, and economic law＂. Based on the pursuit of modernization goals, the country has continued to re- form and opening-up, promoting the ＂modernization of the system＂ and enabling modern economic law to be generated. There- fore, the realization of modernization is a common premise and connection point for advancing reform and opening-up and eco- nomic law formation, as well as the goal and medium. Itis conducive to understanding the necessity of constructing the modern e- conomic law institution and the function and special importance of the economic law in advancing the modernization of the country ＂s governance for rethinking the logic of the formation of the economic law system in the process of reform and opening-up from the perspective of modernization. It also helps to enrich the occurrence theory of economic law and advancerelated research onthe ＂development theory＂.
