行政“不作为乱作为”现象的制度分析——以近十年(2007—2017)的相关报道为文本

The Institutional Analysis of Administrative“Nonfeasance and Misfeasance”Phenomenon:Based on the Relative Reports in the Past Decade(2007—2017)

行政"不作为乱作为"具有深刻的制度根源。以规章制度滞后、职业道德缺失、社会关系扭曲、模仿行为悖逆、认知能力低下、组织文化落后等六个制度分析的变量为标准框架,运用内容分析法对我国目前存在的一些行政"不作为乱作为"现象进行文本分析,发现导致行政"不作为乱作为"的制度因素并不均衡,其中精神懈怠是首要因素,其次包括作风漂浮、违规违法、权力本位与职业认知能力低下。此外,规章制度滞后与社会关系扭曲也是不可忽略的诱发因素。因此,亟须国家着力推进公务员职业道德建设工程,提升行政人员的职业认知能力,加强权力清单制度建设,深化决策制度、审批制度和干部选任制度改革,抑制行政活动中消极功能的社会网络关系。

The administrative nonfeasance and misfeasance has a profound institutional reason. Taking the six institutional analysis variables as the standard framework including the outdated rules and regulations,lack of professional ethics,social relationship distortion,imitation disobedience,low cognitive ability,and backw ard organizational culture,the study used the content analysis to analyze the administration phenomenon. The paper found that institutional factors are not balanced. The mental slackness is the primary factor,follow ed by non-realistic administrative style,violation of law and regulation,low professional cognitive ability and authoritarianism. In addition,outdated rules and regulations and social relationship distortion are the inducing factors that cannot be ignored. Therefore,we need urgently promote the civil servant professional ethics construction,improve administrative personel's professional cognitive ability,strengthen the construction of the"duty list "for the officials in power,reform the decision-making system,examining and approving system and cadre selection system,and inhibit negative functions of social network relation in administrative activities.
