高校混合所有制办学形式是指由代表公有资本和非公有资本两种不同所有制的办学主体,以资本、知识、技术、管理等要素共同参与办学并享有相应权利的方式和途径。从兼顾所有制属性和法人属性的角度来看,可分为所有制属性为公的非营利性混合所有制、所有制属性为私的非营利性混合所有制、所有制属性为私的营利性混合所有制三类办学形式。具体样态包括政府与基金会合作办学、公办高校委托管理办学、公办高校二级学院混合所有制办学、所有权为公的PPP项目、公私共同举办的非营利性民办高校、具有独立法人资格的中外合作高校和公共财政经费支持的非营利性民办高校等多种。

The forms of mixed ownership of colleges means that the school-running sub- jects consisting of public and private property run colleges together through the way of the elements of capital, knowledge, technology and management, and they enjoy their rights. From the perspective of ownership attribute and corporate property, they could be divided into three types as public non-profit colleges, private non-profit colleges and private profit colleges. And there＇re many forms, such as cooperative college operatin by the government and foundation, mandatory college operation by the public university, mixed ownership of secondary college of the public university, PPP program owned by the public, private non- profit college held by the public and private subjects, Sino-foreign cooperative college with corporate property and private non-profit college supported by the public finance funds.
