摘要
在附不动产抵押权的主债权转让场合,就不动产抵押权是否需要办理移转登记这一问题,学说理论上存在两种对立的观点,相应的,司法实践中各法院的判决也存在这样的分歧。最高人民法院在"湖南绿兴源糖业有限公司、丁兴耀等借款合同纠纷申请再审案"的裁定书中认为无须登记即可生效,结论殊值赞同,但并未清晰地就法律解释上的矛盾作出全面的回应。事实上,各法条都有各自的规范本旨与范围,其矛盾之处仍需通过解释作业达到调和,在对判例分析的同时,仍有进一步反思完善的必要。
In the case of the transfer of the main creditor's rights with real estate mortgage, there are two opposing viewpoints on whether the real estate mortgage should be transferred and registered, and correspondingly, there are such differences in the judgments of the courts in the judicial practice. The Supreme People's Court in the "Hunan Green Xing Yuan Sugar Co., Ltd.,Dingchengyao and other loan contract disputes application" in the ruling that no registration can enter into force, the conclusion of the agreement, but did not clearly in the legal interpretation of the contradictions in a comprehensive response. In fact, each law has its own norms and scope, its contradictions still need to be through interpretation of the work to reconcile; in the case analysis, there is still a need for further improvement.
