世界各国的反垄断执法机构在2017年展现出较为激进的执法风格,不仅敢于开出创纪录罚单,也勇于尝试突破性的"第一案"。反垄断司法机构也在数起涉及知识产权与数据的反垄断案件中做出重要判决。本文主要以美国及欧盟的司法辖区作为考察对象,从中精选出十大案例,案件类型覆盖滥用市场支配地位、滥用知识产权的垄断、并购等。本文所评析的案例在调查处理的复杂程度、竞争分析的深度和前瞻性方面均具有代表性。笔者希望通过对这些案例的整理、分析与介绍,为中国的反垄断实务工作和理论研究提供启示与借鉴。

Global antitrust enforcement agencies continue its intensifying antitrust scrutiny in 2017. Those enforcement agencies not only imposed record antitrust fines, but also investigated breakthrough unprecedented cases. The courts also rendered judgments on antitrust issues regarding intellectual property and data. This article provided analysis on 10 major antitrust cases selected mainly from the jurisdictions of the United States and the European Union. These cases cover abuses of dominant position, abuse of intellectual property rights, and M＆A etc. The cases reviewed in this article are representative of the complexity of investigation process, the depth of competition analysis, and the forward-looking aspects. The introduction and analysis of these cases will give reference to China＇s anti-monopoly practice and theoretical research.
