近年来,高校教学管理中违法性案例频现,主要表现在程序失误、管理规章与上位法相抵触等方面。究其原因,主要有以下几个方面:一是有些高校管理者法律意识淡薄;二是程序管理有瑕疵;三是学校管理"内部执法系统"存在某些混乱;四是惩戒学生的规章具有单方强制性;五是社会对高校的监管缺位。为了防止和减少教学管理的违法失误,应当根据法律的要求进行规制。

In recent years, illegal cases of teaching management in colleges and universities have occurred frequently, such as illegal decision procedure and contradiction between management regulations and superior laws. The reasons for these mainly include weak legal awareness of some college administrators, flaw in procedure management, confusion in the＂internal enforcement system＂of school management, unilaterally mandatory rules governing students, and finally lack of supervision of the society for colleges and universities. In order to prevent and reduce illegal teaching management mistakes, it should be regulated according to the requirements of law.
