论条约的“被当事国嗣后惯行修正”

The Amendment of Treaties on the Subsequent Practice after its Establishment

条约是最重要的国际法渊源之一,条约的修正问题不仅能激起理论上的兴趣,于实务亦有实益。条约能否被"当事国嗣后惯行"修正这一问题在理论上素有争议,尽管此次国际委员会报告对"条约被当事国嗣后惯行修正"这一概念持怀疑态度,但是,这种条约修正方式实际上是存在的。从实践与法理上来看,"条约被当事国嗣后惯行修正"这一概念具有其合理性,不必将其完全摒弃。不过,修正条约的"当事国嗣后惯行"须从严把握,以确保条约的稳定性。

Treaty is a principal source of the international law,and therefore the amendment of treaties not only attracts theorists but also is important in practice. Whether the treaty can be amended by the subsequent practice is disputed. Even though the report of the International Law Commission has doubted the justifications of the amendment by subsequent practice, this mode of the amendment exists. From perspectives of practice and jurisprudence,＂Treaty Amended by Subsequent Practice＂is justified to some extent,and there is no need to abandon this concept. Nevertheless,＂Treaty Amended by Subsequent Practice＂shall be applied in strict sense to guarantee the stability of treaty.
