人民法庭在基层法院员额法官养成中的作用机理——以人民法庭诉与非诉二元功能区分为前提

员额法官改革在保证了审判质量的同时,也产生了大量基层法院未成为员额法官的法官助理的培养问题。而人民法庭则因其可以鲜明反映基层社会的司法现状,以及作为司法改革"试验田"最佳选择等功能,与员额法官的职业特征要求存在较好的契合性,对其职业能力的养成具有良好的促进作用。这一作用包括作为法律理论学以致用的最佳场所、促进法官助理审判经验的增加和人民法庭可以承担更多的非诉职能等诸多方面。因此,可以通过疏通法官助理进入人民法庭锻炼的制度化渠道、构建激励法官助理对人民法庭审判工作的积极参与机制、创新科学的法官助理职业能力的训练模式,以及开展人民法庭非诉职能的优化改革等路径,促进法官助理职业能力的养成。

The reform of post judge has ensured the quality of trial,but also produced the problem that how to train a large number of grassroots judges＇ assistant judges. The people＇s court,because it can clearly reflect the judicial status of the grass-roots society,as well as the best choice of the ＂test field＂of the judicial reform,has a good agreement with the professional characteristics of the post judge,and has a good promotion effect on the cultivation of its professional ability. This role includes the best place for legal theory to use,an increase in the trial experience of the judge＇s assistant,and the people ＇s court to take on more non-prosecution functions.Therefore,we can promote the institutionalized channels of the judges ＇ assistant to the people＇s court,build the active participation mechanism of the judges＇ assistant to the trial of the people＇s court,innovate the scientific training mode of the professional ability of the judge assistant,and carry out the optimization reform of the non litigation function of the people ＇s court,so that to promote the cultivation of the professional ability of judges＇ assistant.
