分享经济的监管困境及其治理

The Dilemma and Governance of Supervision on Sharing Economy

分享经济作为依托互联网信息交互平台建构的一种新业态和新模式,其在促进交易方式革新、推动商业模式衍进、拉动经济增长方面显示出巨大潜力,但同时也对现有的政府监管体系提出了新的挑战,政府对分享经济的监管面临一系列的缺位、越位、错位问题。究其原因,主要在于传统管控型监管理念与分享经济运行不相适应、政府监管制度滞后于分享经济模式创新、现有监管模式的僵化以及监管工具的创新性不足。为此,本文提出由传统管控型思维转换为创新友好型思维、加快修订适应于分享经济业态的相关法律法规、构建"政府-平台-企业-社会"多元共治的协同监管模式、创新政府监管工具四个层面的适应性治理路径,以期破除政府在分享经济监管领域的困境,最大限度的发挥监管效力。

As a new business pattern based on the internet information exchange platform, sharing economy displays great potential in promoting the innovation of trading patterns, transformation of business mode and economic growth. However, sharing economy also brings new challenges for the present government supervision system,and the government faces a sequence of problems such as absence, offside and dislocation in terms of sharing economy supervision. The underlying cause lies in the following aspects： mismatch between the traditional control-type concept and the sharing economy operation; the fact that the government supervision system lags behind the innovation of the sharing economy mode; the path relies on the existing supervision model, and the lack of innovation of supervision tools. In view of the above analysis, this paper proposes the following four countermeasures in the hope of breaking the government off the dilemma in the field of sharing economy supervision and maximizing its supervising effect. First, the traditional control-type thought pattern should be changed into innovation-friendly type pattern. Second, the modification of the laws and regulations concerning sharing economy mode should be accelerated. Third,the co-supervision mode of＂ Government platformEnterprise-Society＂ should be built. Fourth,government supervision tools should be innovated.
