Legal Positioning of Governmental Role in Ecological Protection Compensation

在我国政府主导的生态保护补偿机制下,明确政府的角色定位,是构建生态保护补偿法律关系的关键。一直以来,政府的角色定位及功能发挥在生态保护补偿实践中面临诸多难题,其直接原因在于政府的自然资源所有者代表身份与生态保护补偿监督管理者身份混同,为此,亟待推进两权分离。进一步讲,政府角色定位的理性回应,取决于三个更深层次关系的厘定:公众与政府的关系;央地财权事权的关系;政府与市场的关系。

Under the government-led mechanism of compensation for ecological protection, clearly defining the role of government is the key to building a legal relationship of ecological protection and compensation. All along, the government＇s role positioning and function are faced with many problems in the practice of compensation for ecological protection. The direct reason is that the representative of the natural resource owner of the government is in conflict with the identity of the administrator of ecological compensation. Therefore, it is urgent to promote the two rights separated. Furthermore, the practical predicament and rational response to the role of the government are determined by the determination of three deeper relations： the relationship between the public and the government; the relationship between the financial powers and powers of the central government; and the relationship between the government and the market.
