摘要
本文主要关注德国公法学家卡尔·施米特提出的"大空间秩序"。按照施米特的论断,"普世帝国"产生自"大空间秩序",空间秩序变革则是基于"例外状态"。在宣告"例外状态"的空间秩序中,一方面划出了法律生效的范围,另一方面则宣告了这个空间的自由。对于国际秩序而言,当普世帝国力图走向单一政治体系时,"例外状态"就成为帝国行动的直接前提。施米特希望德国在美苏两个超级大国争霸的夹缝中捍卫欧洲文明,从而为世界和平秩序奠定稳固根基,维系战后的世界和平。
According to Schmitt's thesis,the"universal empire"is generated from the"great space",and the spatial order is based on the state of exception. In the space order in which the"state of exception"is proclaimed,the sphere of legal validity is delineated,while at the same time the space is declared free. In regard to the international order,when the universal empire moves towards a single political system,the"state of exception"becomes the direct premise for imperial action. This article focuses on the"great space"order proposed by Schmitt in his later years,in which he hopes that Germany will defend European civilization in the midst of the hegemonic competition between the United States and the Soviet Union and,in this way,lay a solid foundation for lasting world peace and order after the world war.
