“一带一路”跨境电子商务在线争议解决机制研究——以欧盟《消费者ODR条例》的启示为中心

On the Online Dispute Resolution Mechanism of Cross-border E-commerce in “The Belt and Road” Initiative: Focusing on the Enlightenment of EU Regulation on Consumer ODR

"一带一路"跨境电子商务是中国与沿线国家经贸合作发展的重要内容。电子商务持续、健康、稳定的发展需要良好的法治环境。与此同时,电子商务的发展与规则供给不足之间的矛盾日益凸显。中国与沿线国家之间尚未形成统一的ODR机制,且电子商务因其具有跨地域性、虚拟性等特点,使得消费者争议的可诉性及可执行性面临困境。欧盟《消费者ODR条例》丰富和发展了消费者争议解决机制,并加强了对个人信息和数据的保护。这对中国与沿线国家之间构建一个共享共赢的ODR机制具有重要启示:坚持消费者特别保护原则;搭建多语种ODR平台,借助沿线国ADR机构解决争议;注重经营者及消费者信息和数据保护。此外,推广中国司法改革经验,建立"一带一路"在线争议解决中心。

In ＂The Belt and Road＂ initiative, cross-border e-commerce is an important part of the development of China＇s economic and trade cooperation with countries along the belt and road. Therefore, the continuous, healthy and stable development of e-commerce requires a good legal envi- ronment. At the same time, the contradiction between the development of e-commerce and the insuf- ficient supply of rules is becoming increasingly prominent. As there is no unified ODR mechanism between China and the countries or regions along the belt and road, and because of the cross regional and virtual features of cross-border e-commerce, the justiciability and enforceability of cross-border online consumer dispute are faced with difficulties. The European Union Regulation on Consumer ODR may enrich and develop the consumer dispute resolution mechanism, and strengthen the protec- tion of consumer personal information and data. It has important implications for building a win-win ODR mechanism between China and the countries along the belt and road： adhering to the principle of special protection for online consumers, establishing a multi-lingual ODR platform to resolve dis- putes through ADR agencies in countries along the belt and road, focusing on information and data protection, promoting the experience of China＇s judicial reform practice and making an effort on the establishment of ＂The Belt and Road＂ ODR center.
