19世纪末20世纪初的中国社会面临着复杂的历史环境,社会结构的剧变与东西文化的碰撞集中表现为传统与现代的冲突,而中国传统的婚姻制度更是成为旧式尊卑有差的家制内核之代表形态,在人格平等的民主风潮之中,成为制度变革的主要矛盾点之一。在复杂的社会局势下,这一时期的法律精英们对婚姻制度的立法工作坚持一种审慎的态度。然而,在特殊的历史时期,婚姻制度的近代化变革能否从法律文本上贯彻于新生的市民社会中,仍需综合考量。

The Chinese society in the late 19 th and early 20 th century faced a complex historical environment,the drastic changes in social structure and the collision between eastern and western cultures are concentrated in the conflict between tradition and modernity. But the traditional marriage system in China has become the representative form of the old style hierarchy in the family system,in the democratic trend of equality of personality,it has become one of the major contradictions of institutional change. Under the complicated social situation,the legal elites of this period adhered to a cautious approach to the legislative work of the marriage system. However,in the special historical period,whether the modernization of the marriage system can be implemented in the new civil society from the legal text still needs comprehensive consideration.
